Thanks in large part to the conservative majority on the US Supreme Court, Texas was allowed to impose a strict immigration rule that has been denounced by opponents as an infringement on human rights for a brief time on Tuesday. The nation’s highest bench’s involvement set off a day of convoluted legal border drama that did nothing but deepen the unrest around the country’s overburdened immigration system, strengthen the court’s political bent, and ignite new border drama debate over a matter that puts President Joe Biden’s reelection at risk.

This bill challenges the federal government’s jurisdiction on immigration matters by enabling Texas to arrest and potentially deport anyone it believes is crossing the border illegally.

Amid Approaching General Elections Border Drama Continues

Briefly, after the Supreme Court ruled that the statute may go forward while lower courts completed their appeals process, it became operative. However, the 5th Circuit Court of Appeals delayed the law’s implementation once more late on Tuesday night, dampening festivities in the Lone Star State. The judges who rendered the late-night decision are scheduled to hear arguments over SB 4 on Wednesday morning.

As the general election approaches, the increased ambiguity around the legislation will further intensify the contentious immigration issue, which is being spearheaded by Republican front-runner Donald Trump. Furthermore, the Supreme Court’s decision gave Republicans a platform to promote their strict immigration laws and assert that Biden no longer had control of the border, even if it was eventually overturned.
