A battle over the separation of powers between Congress and the Biden administration is intensifying between the House Judiciary Committee and two Justice Department tax prosecutors involved in the criminal investigation of Hunter Biden. Republicans have been attempting to interview these prosecutors for months. The lawsuits are now going to court.

The Republican-led committee sued federal tax prosecutors Mark Daly and Jack Morgan in federal court in Washington, DC. Since September, the committee has been requesting that the men appear as part of its investigation into the Biden family’s impeachment.

On Thursday, the lawsuit requested that the court intervene right once and issue an emergency order compelling Morgan and Daly to testify. That is not likely to happen, though, as these kinds of lawsuits are usually used as a political ploy in congressional standoffs with the executive branch when opposing political parties control Congress.

In the course of their investigation into the DOJ’s handling of the president’s son’s criminal case, Republicans have expressed a desire to speak with both Morgan and Daly. Specifically, they want to know about meetings and discussions between federal investigators as well as the Departments’ drawn-out decision-making process before charging Hunter Biden with tax evasion. Republicans focused on these two career prosecutors after IRS informants said Daly and Morgan had changed their views and supported prosecuting the president’s son for tax offenses.
